TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of the WordCards mobile application ("App") and any related services provided by Batuhan Bayır (doing business as WordCards, "we," "us," or "our").

By downloading, installing, or using the App, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use the App.

1. ACCEPTANCE OF TERMS

By accessing or using WordCards, you represent that you are at least 13 years of age (or the minimum age required in your country to consent to digital services). If you are using the App on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

If you download WordCards through the Apple App Store, Apple's standard Licensed Application End User License Agreement (EULA) also applies to your use of the App, and Apple is not responsible for the App or its content.

2. DESCRIPTION OF SERVICE

WordCards is an English language learning application that offers the following core features:

To access personalized features, you must create an account by signing in using Apple Sign-In or Google Sign-In. You are responsible for:

You may not create accounts using automated means or impersonate any person or entity. We reserve the right to suspend or terminate accounts that violate these Terms.

4. SUBSCRIPTIONS AND PAYMENTS

Free and Premium Access

WordCards offers both free and premium (subscription-based) tiers. Certain features and content levels may require an active subscription to access.

Billing

Subscriptions are billed through the Apple App Store or Google Play Store, depending on your platform. Payment is charged to your store account upon confirmation of purchase. All billing, refund, and cancellation policies are governed by Apple or Google, respectively:

Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time in your device's App Store or Play Store account settings.

Price Changes

We may change subscription prices at any time. Price changes will be communicated through your App Store or Play Store notification system and will take effect at your next renewal cycle.

No Refunds

We do not offer refunds directly. All refund requests must be directed to Apple or Google through their standard refund processes.

5. LICENSE AND INTELLECTUAL PROPERTY

License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial language learning purposes.

Our Content

All original content in the App — including word definitions, example sentences, UI design, graphics, and audio — is owned by or licensed to WordCards and is protected by applicable intellectual property laws.

YouTube Content

Video clips displayed within the App are sourced via the YouTube API Services and are subject to the YouTube Terms of Service. WordCards does not claim ownership of third-party video content.

6. USER-GENERATED CONTENT

When you use the AI chat feature, you may submit text or voice input ("User Content"). By submitting User Content, you grant us a limited license to process and transmit that content solely to provide the requested AI service.

You are solely responsible for your User Content. You agree not to submit content that is unlawful, abusive, harmful, or that infringes third-party rights. We do not claim ownership of your User Content and do not use it to train our own AI models.

Chat sessions are stored in our cloud database for up to 25 messages per session. Older messages are automatically deleted from our servers on a daily basis. You may delete your chat history at any time from within the App.

7. AI-POWERED FEATURES

WordCards integrates third-party AI services (such as large language models) to power the chat assistant and voice-to-text features. By using these features, you acknowledge that:

8. NOTIFICATIONS AND REMINDERS

With your permission (requested in the App on iOS and on Android 13+), WordCards schedules local daily practice reminders on your device at approximately 12:00 PM your local time. These reminders are generated entirely on your device and no reminder content is transmitted to our servers.

You can disable reminders at any time from your device's Settings → Notifications → WordCards, or from within the App's Settings screen. Disabling notifications does not affect any other App functionality.

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any specific learning outcome, vocabulary improvement, or language proficiency gain will result from use of the App.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WORDCARDS, ITS OWNER, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. TERMINATION

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is otherwise harmful to other users, us, or third parties.

You may terminate your account at any time by deleting your account from within the App's Settings screen or by contacting us at wordcards.helpdesk@gmail.com. Upon termination, your right to use the App will immediately cease. Sections 5, 11, 12, and 15 shall survive termination.

14. CHANGES TO THESE TERMS

We may update these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you through the App or by email. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

15. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bursa, Turkey.

If you are a consumer residing in the European Union, you may also benefit from any mandatory provisions of the law of the country in which you are resident.
